Please read these Terms and Conditions carefully and ensure that you understand them before using our website or placing orders.

By placing an order with Burkov&Burkov Limited (“us” or “we”) you will be deemed to have read, understood and agreed to these Terms and Conditions. If you are unhappy with any aspect of these, then you should contact us via email at help@burkovandburkov.co.uk before placing an order with us. Please note your confirmation of order and any correspondence with us will be in English.

These Terms and Conditions and your use of our website are governed by English law and you agree to submit to the non-exclusive jurisdiction of the English court. This does not affect your non-excludable statutory rights.

Whilst we are happy to consider requests for products and enquiries from outside the United Kingdom, we give no warranty, express or implied, that the use of this website or the placing of any order through this website from outside the UK complies with any applicable non-UK laws or regulations. Accordingly, any products or promotions not permitted under your local law cannot be offered to you.

A contract between you and us for the sale of our products and/or services will only exist once an order has been either paid in full or partially paid and accepted and processed.

All transactions and prices quoted on this web site are shown in £ Pound Sterling. 

Production, Delivery & Installation Timescales

Occasionally, availability of goods and delivery timescales are subject to change. If this happens, you will be informed of the changes. Every effort is made to ensure that this will not happen. Production, delivery and installation dates are quoted genuinely as an estimate and are not be legally binding on us.

The time of production, delivery, installation or collection shall not be of the essence with respect to the contract with you. 

Limitation of Liability

We will only be responsible for any losses you suffer as a result of us breaching these terms and conditions and/or any contract if the losses were reasonably foreseeable to both you and us when you started using our website or when a contract was formed.

We will not be liable for any direct or indirect loss of profits or other financial loss or damage suffered by you through any delay due to unforeseen circumstances outside of our control.

Unless otherwise required by applicable laws, if we unable to supply goods subsequent to receiving an order, we will not be liable for any incidental or consequential loss either directly or indirectly, including loss of profits, business, depletion of goodwill and similar loss, costs, damages, charges or expenses caused directly or indirectly.

Notwithstanding any provision of these Terms, we do not exclude or limit our liability for:

(a) death or personal injury caused by our negligence or that of any of our officers, employees or agents; or

(b) fraud or fraudulent misrepresentation; or

(c) any liability which it is not lawful to exclude either now or in the future.

Goods made to order

All Goods that are ‘made to order’ are clearly labelled as such on our website.

Goods that are clearly labelled ‘made to order’ are excluded from our standard cancellation policy and therefore we will not ordinarily be able to change such orders, make a refund or exchange any ‘made to order’ item and therefore you should only place your order if you are sure that the item and finish is right for your needs. This does not affect your statutory rights.

Goods that are ‘made to order’ that are found to be damaged upon receipt or faulty should be returned via our standard damaged goods returns policy

We cannot refund orders or items where they are made to order especially for customers. 

Accepting your Delivery 

Before accepting your item from the courier please thoroughly check inside the boxes beforehand at the point of signing, even if the boxes appear to be in perfect condition.

If the items are not in perfect condition, then please do not accept them and contact us via email at help@burkovandburkov.co.uk. Please ensure you clearly mark the courier’s paperwork with a description of the problem. Once items are accepted, signed or not, we will not be held responsible for any loss or damage whatsoever. Signing for items as “unchecked” is not acceptable.

Payment & fees

Goods must be paid in full upon placing an order.

All interior design fees must be paid upfront prior to any commencement of work and/or delivery of work. We are unable to refund any design fees once the work has commenced.

Dimensions & product modifications

Dimensions given may vary very occasionally and slightly from what is advertised due to items being made by hand and being customised.  Should your size need to be exactly as ordered please make this known at the point of ordering.

We reserve the right to introduce technical modifications and variations for the purpose of quality. 

Clearance and Ex Display items

Items sold as clearance or ex display will be marked as such. These items are sold as seen.  Any flaws, marks or general wear and tear are noted at the point of order.

We cannot accept clearance or ex display items back for refund or exchange unless the item has a manufacturing fault.

Delivery within the UK

You will be contacted once your order is ready to be despatched and advised of an expected delivery date and time. Items that are generally smaller and considered safe to send by a standard parcel company will be despatched in this way.  It is not always possible to know exactly when these items will arrive.

In the unlikely event that your purchase is received damaged then we will, of course, replace, exchange or refund including the cost of the courier but only if the items damaged have not been signed at delivery in good condition which will invalidate a claim for replacement.

Amending, cancelling or returning your order

If you would like to add goods to an order you have already placed, please place a new order for these items. If you need to change details of your delivery address or amend a delivery time, please contact us via email at help@burkovandburkov.co.uk.

If you no longer want the good(s) you purchased, please contact us in writing or another durable medium within 7 working days of taking delivery and we will be happy to make a refund or exchange, unless the item(s) have been made to order. Please note we cannot refund special orders or where items have been made to a customer’s own specification.

Please note that we do not offer a free returns service, you are required to organise and pay for the transportation of any unwanted return yourself. We do not refund the original delivery charge paid.

Before returning your purchase, please ensure the goods are in the same condition as they were originally sent. Unwanted items must be returned in a fully resalable condition, which includes being in the original, unmarked and undamaged packaging. Items must not have been used or assembled in any way. We do not accept responsibility for items lost or damaged in transit back to us. If you return your purchase by mail we recommend that you get proof of postage. We can refuse a refund on any item deemed not to be resalable.

Items Out of Stock

Should an item be out of stock, you will be advised as soon as we receive your order and you will have the right to cancel with a full, immediate refund or your item can be put on to back order and we will advise you of the expected date of despatch.

Errors

In the event that a product is listed at an incorrect price due to technical error or error in pricing information, we can refuse or cancel any orders placed for a product listed at the incorrect price. If your credit card has already been charged for the purchase and your order is cancelled, we will issue a credit to your credit card account in the amount of the incorrect price.

Sizes and specifications given may vary very occasionally and slightly from what is advertised due to items being made by hand. Should your size and specification need to be exactly as ordered please make this known at the point of ordering.

Refusal of Transaction & Eligibility of Purchase

We reserve the right to withdraw any products from our website at any time and/or remove or edit any materials or content on our website.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any product from our website whether or not that product has been sold; removing or editing any materials or content on the website; refusing to process a transaction or unwinding or suspending any transaction after processing has begun.

Force Majeure

We reserve the right to cancel, vary or suspend the operation of contracts of sales if events occur which are beyond our control including (and without prejudice to the generality of the foregoing) fire, floods, storm, plant breakdown, lock-outs, riots, industrial action which prevents entry to premises, hostilities, non-availability of materials or supplies or any event outside our control and we shall not be held liable for any breach of contract resulting from such an event.

Bank Charges

We cannot accept any responsibility for customer’s bank charges.  Any payments made must be to the full requested amount. Orders will not be processed and/or despatched until the correct amounts have been received.  

Disputes

We will always make every effort to offer the highest level of customer service. The contract between you and us is governed by the law of England and Wales and any dispute will be resolved exclusively in English Courts and in English language only.

Entire agreement

These Terms, together with our current website prices, delivery details, contact details and data protection and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us.
